Support Police Chief Mark Kessler in his 2nd Amendment Preservation Ordinance

I am asking all my viewers to help support Police Chief Mark Kessler in his 2nd Amendment Preservation Ordinance that he will be presenting at 7PM on January 24, 2013, at the Gilberton Borough Council meeting, located at 2710 Main Street, Mahanoy Plain, PA.

Concerned about future federal and state legislation that infringes on the Second Amendment, Gilberton Police Chief Mark Kessler drafted a proposed 2nd Amendment Preservation Ordinance. The text of the proposed Ordinance is below.

I am asking everyone to support Chief Kessler by either attending the meeting or by sending a letter or email to Borough informing them of your desire that they enact Chief Kessler’s Ordinance. Some proposed language for your email, fax or letter is directly below. Please do your part to support Chief Kessler, the 2nd Amendment and Article I, Section 21 of the Pennsylvania Constitution.

Dear Council Members:

I am calling/writing today to ask you to please support and enact the proposed 2nd Amendment Preservation Ordinance of Police Chief Mark Kessler.  The federal government, based on Vice President Biden’s comments, appears intent on violating our Second Amendment, as well as, Article 1, Section 21, of the Pennsylvania Constitution. The 10th Amendment specifically provides that the states may nullify unconstitutional acts of the Federal Government and many states have passed nullification acts, such a Firearms Freedom Acts – see, as one of many examples.

I feel it is incumbent upon our states and cities to take action to protect communities from illegal firearm seizure and unconstitutional laws that seek to limit and restrict law-abiding citizens from owning, purchasing and possessing firearms. The seizure and denial of firearms to law-abiding citizens is unconstitutional based on the plain language of the 2nd Amendment. Our forefathers fought the English, almost to their demise, for the freedoms that so many now take for granted.  I am requesting that you show your American Patriotism and support our 2nd Amendment. If no action is taken, it will only be a matter of time before the remaining Amendments are also denied to the People.

I hope you will stand with the vast majority of Americans that want our Constitutional protections enforced and adhered to by the Federal and State Governments.

Please pass the 2nd Amendment Preservation Ordinance as soon as possible. A majority of your constituents support this effort.

2nd Amendment Preservation Ordinance

AN Ordinance, which shall be known and may be cited as the “2nd Amendment Preservation Ordinance.”

To prevent federal, State or local infringement on the right to keep and bear Firearms, Firearms accessories or ammunition ; nullifying all federal, state or local acts in violation of the 2nd Amendment to the Constitution of the United States along with section 21 “Right to Bear Arms of the Pennsylvania constitution.



The Governing body of the Borough of Gilberton within the state of Pennsylvania finds that:

A. The 2nd Amendment to the Constitution of the United States reads as follows, “A well-regulated militia being necessary to the security of a free state, the right of the people to keep and bear arms shall not be infringed.” Along with Section 21 of the constitution of Pennsylvania which states, “Right to Bear Arms.” The right of the citizens to bear arms in defense of themselves and the State shall not be questioned.

B. All federal, state or local acts, laws, orders, rules or regulations regarding firearms, Firearms accessories or ammunition are a violation of the 2nd Amendment along with section 21 of The Pennsylvania Constitution and in violation of this ordinance.



A. The Governing Body of the Borough of Gilberton within the state of Pennsylvania declares that all federal ,state or Local acts, laws, orders, rules, regulations – past, present or future – shall be in violation of the 2nd Amendment to the Constitution of the United States and the Constitution of Pennsylvania are not authorized by the Constitution of the United States and the Constitution of Pennsylvania and violate its true meaning and intent as given by the Founders and Ratifies, and are hereby declared to be invalid within Gilberton Borough and all of its boundaries , shall not be recognized by this Borough or within all of its boundaries within the state of Pennsylvania, are specifically rejected by the Borough of Gilberton and within all of its boundaries within the state of Pennsylvania, and shall be considered null and void and of no effect in the Borough of Gilberton within the state of Pennsylvania.

B. It shall be the duty of the Governing body of Gilberton Borough and within all of its boundaries within the State of Pennsylvania to adopt and enact any and all measures as may be necessary to prevent the enforcement of any federal, state or local acts, laws, orders, rules, or regulations in violation of the 2nd Amendment to the Constitution of the United States along with section 21 of the Pennsylvania Constitution or any violation of this ordinance.



A. This act takes effect thirty ( 30 ) days upon approval by the Governing body

  1. I completely support this, and will forward this on to my local Police Chief. I am a multiple pistol and rifle owner. I am also a retired Army Aviation Tech, who would still defend this country if asked. I will be damned for someone to take away the laws and freedoms in which I have fought and defended.

    I am totally in support of this and hope my local police chief will agree to this also as I will present it to them. We need to all stick together in this, it is the only way we can effectively overcome this attack of our rights!

  8. Chief Mark Kessler We love you!! I live in California and We have no one fighting for our rights here. They were so happy to pass the gun ban here. Please let us know what we can do when our state is so corrupt and now we will not be able to defend ourselves …..?
