Today, it was reported by My Fox Philly that “heavily armed” Pennsylvania State Police (PSP) Troopers “guarded an entrance into a neighborhood or area where they believe 31-year-old suspected cop killer Eric Frein may be hiding” and were “checking every vehicle leaving,” without any warrants or probable cause. In further violation of these individuals’ rights, the article declares that ” [l]ocal residents still have not been able to get back into their homes since last night, with some sleeping in shelters, others in their cars.”

      2. There are truths in everyone’s posts. Police in general are honorable public servants. However, they do tend to go overboard at times. Remember the Boston Marathon bombings? Forcing people out of their homes with weapons aimed at them! No one is faulting the police for trying to protect us. Keeping people out of their homes AFTER being checked is not right. Allowing law enforcement in the name of safety to stomp on rights is a slippery slope. Perhaps the law firm could have waited until this was over and then they would have been perceived to be less insensitive. Just because violating our rights (forcing searches and keeping one from going home) may be seen as minor infractions, ANY violations of our rights is important to identify and stop. What if the PSP, (and this is just an example, not an accusation), thought someone knew where the alleged gunman was and beat the truth from that person? All violations of rights, however seemingly minor, is important. I’d get him some clothes food and a ticket to the Dominican Republic where there is no extradition and the dead cop is no hero I know him from when I got hit by a truck in my front yard and having dealt with PSP before I would not allow him inside. He opened the door anyway when I shut it and walked away letting all three of my dogs out one of which I have never seen again. So yes I would help him all I could and justice for all.

As the daughter of a retired PA State Trooper I find this COMPLETLEY OFFENSIVE and in very POOR TASTE. How would rights be violated if this nut case was armed and in this vicinity and shot someone & there was no one around. I lived through the Sniper shootings in DC 12 years ago, scared to death and yes, stopped at check points, which actually kept me safe until Lee Boyd Malvo was caught. You disgust me.     3. If there are a thousand cops assigned to this search, then a thousand other police duties are being neglected. How much of an undue risk factor does this create for supposed “public safety” in general? If a thousand cops can’t catch this suspect, maybe the cops really are headless chickens playing cowboys and indians. The cops say that they don’t believe the suspect to have any intention of attacking citizens but only cops. The cops also rave about how militarily adept the suspect is with months or even years of planning for this event, and yet he drives his jeep into the pond (maybe a legitimate blunder) but leaves his drivers license and other easily removable evidence behind. Maybe this was all part of his plan along with the sniper diapers stashed in the woods 18 miles away from the pond. The cops haven’t confirmed whether the AK-47 found in the woods is the same AK-47 missing from the dad’s house. Surely an elite sniper would have left all these items behind to be so easily found by the thousand cops who can’t seem to find the suspect in a five square-mile zone. If the suspect is extravagantly staging a suicide by cops stunt, then why isn’t he picking off a few of these thousand headless chickens – just for sport and to keep the game exciting? If he stashed the sniper diapers, surely he would have stashed food and other supplies too. Its hard to determine the highest factor of moronic behavior in this story…the headless chickens…the headhunter…or the gullible citizens who can’t seem to see through this charade of propaganda and realize that they’re the ultimate victims of their conditioned phobia of dying at the hands of a ill-minded criminal as opposed to a million other possibilities for death. Praise the lord for civil rights activists and attorneys who take the public bashing for refusing to throw out the baby with the bathwater.

I can tell you from experience though, Joshua Prince is the last thing from an opportunistic lawyer. He is one of the few left that fiercely defends our rights that are constantly violated. Not sure where you saw I was pressing charges (I’m not). You stated this man killed people protecting my rights; I’m not aware of a situation where my rights were directly protected by an officer, although that can be debated at different levels. Not sure about the comments about protecting you, my employer, or walking down a dark alley, that is not my job. I know many veterans, not sure how that relates to the situation.

  7. The 4th Amendment protects against “UNREASONABLE” searches. Considering there is an armed lunatic, who played too many pretend war games, is on the loose somewhere in that area, it is not unreasonable to conduct searches. It also benefits the citizens of that area, making sure there homes remain safe and secure from this lunatic. It is not unreasonable to assume that he may have help – someone trying to get him out. It is also not unreasonable for anyone to assume that the lunatic climbed into someone’s trunk to get out of there.

    Cops are damned if they do or damned if they don’t because if there was NO police presence there and someone got shot, hurt, killed, you would probably be advertising for lawsuits against police because they didn’t do enough.

  19. I cannot believe that an officer of the court would seek to capitalize in such a serious matter. You should do a great deal of soul searching and professional introspection regarding your career choice. This is akin to “ambulance chasing” and I hope that your business plan backfires on you.

    Law enforcement is literally “in the crosshairs” of a sick, demented bastard of a killer, who is determined not to go “alive.” With such a risk, and with so much at stake for the public, certainly exigent circumstances dictate that LE do everything within its power, and the law, to protect themselves, and the public.

    I have a better plan. Why don’t you, and your staff, take a walk into the woods with the tactical teams and, after they are done with any civilian contact, speak with them about any violations of their rights. Wear bright yellow or orange jackets while you are at it!

An exception to the warrant requirement when the police believe they have probable cause and do not have time to obtain a warrant. The most often cited example of this is the “hot pursuit” example. For example, The police officer personally sees a suspect run into a house. That is nowhere near the case here. As a matter of fact, police were searching in Plains Township and Monroe County at precisely the same time based upon “tips.” Does this rise to level of exigent circumstances, in both areas??

      If you truly believe this qualifies as exigent circumstances, then the exigent circumstance exception would engulf the entire amendment. Anytime there is a murder in a city/town, the police would be able to stop and search vehicles without consent, order people to remain in their homes, and prevent people from returning to said homes.

      By the way, there was a murder in Wilkes-Barre last week, an individual was shot in the head and left in the grass to be found in the morning. The suspect has not been located, yet there are no lock downs, vehicle stops, road closures etc. Actually, there are about 10, or more, unsolved murders in Wilkes-Barre over the last 18 months. Theoretically, there are at least 10 murderers roaming the streets of Wilkes-Barre, right now. Under your interpretation of exigent circumstances, the PSP should be able to suspend the US and PA constitution searching all of Wilkes-Barre for these individuals.

If you were to review the entire website, the principal area of law that Mr. Prince practices is defending peoples rights (specifically your right to bear arms). He would not be the first to sue a police officer if someone got hurt because the police were following the US and PA Constitutions, quite the contrary. Review his website, and google him. You will see he takes the side of defending the US and PA Constitution, obviously, even when it is unpopular.

    As an attorney it is his job to defend peoples rights, and represent them when they can’t defend them, personally. It’s wrong and I am glad this law office has the balls to say so. I mean we (citizens) are all held accountable for what we do and when we violate any procedure or law.   55. Every time I tried to go home. I would have a machine gun pointed in my direction by a trooper with his (or her) finger on the trigger. Even when my children were in the car. They refused to let us go to our homes. When they PSP did take a break we did make it home, then we could not leave! Men roving through the woods in our community with their machine guns drawn. Helicopters buzzing our houses. My neighbors have been hit by their (PSP) cars because they are speeding all over the area. One trooper told me they were going through the neighborhoods checking to see if any doors were unlocked incase he is inside one of these homes. In the 10 years I have lived here I never had to look my doors. Now I have to lock them because the police are breaking in! I know you think you know what is best for me but….I don’t want your help. I will protect my own family. At this point I have determined that I needed to take my family away from the area because I believe if someone gets hurt around my home it will be because the police did it. That’s how crazy and bad things have become!!! I sure wish this country still had a constitution.

  57. As someone very concerned about the constitution and rule of law, I’m appalled by some of the comments on here. Look, I want the PSP to get their man as much as anyone else, but there are rules that have to be followed, and constitutional rights have that to be respected. One of those rights to to be secure in one’s home and one’s personal effects against unreasonable searches and seizures. We have a legal definition of what reasonable is. Searching vehicles without probable cause is what we call “unreasonable.” Restricting people’s freedom of movement and commandeering their homes also runs afoul of constitutional rights.

    When we decide those can be ignored at the whim of law enforcement, we cease to be a nation of laws and become a police state. Sadly, I think many of you would be fine with a police state.

    Think about what you are saying. If “rights” are such a quaint notion, why don’t we just burn down the whole neighborhood to flush this guy out and summarily execute him when he tries to escape. That would be very effective! Sadly, again, I think may of you would be fine with that, and I’m now ashamed to say that makes you horrible Americans.

      I do have a difference of opinion with stopping vehicles though. I understand having probable cause to search your vehicle, and in a court of law, I would say that if the PSP stopped my vehicle to look for a fugitive and found a pound of weed in my car, that the weed would not be admissible in court because there was no probable cause to search my vehicle. I am no lawyer, but I assume that is how it would go. And I know there is a loop hole of “evidence in subsequent circumstances” (paraphrasing) that they could try to push but that is where Mr. Prince could step in and “protect” the public. In the meantime, what is wrong with stopping traffic and asking for the public’s help, in finding a fugitive?

I can tell you this, I am mid life and decided to go back to school and was studying to be a paralegal. I have been reading all of this and I happen to know several state troopers and the reason they are searching homes is they believed this man may have been in the homes holding people hostage and telling them not to say anything to police. It is the most ridiculous thing about your rights, all of you people who complain about rights would be the first ones wanting the police to do anything possible to take a killer off the street if he had killed your wife, husband or close family member. If police were searching homes for no reason I would get your point but they are doing it to protect people from this maniac.

This BS doesn’t warrant going through a persons home nor keeping them from their homes. We are all adults, knowing how to protect ourselves. Besides, this supposed shooter is only looking to kill police not us!

  64. There are important legal principles at stake here, not just “legalities.” They concern justice, fairness, and constitutional rights.

    Generally it’s ok for cops to set up a traffic stop if they stop EVERYONE and treat everyone consistently, like a DUI “Checkpoint” on New Years Eve. In the DUI context, that does not give them the right to search the car unless they have “reasonable suspicion” that a law has been broken, eg you’re visibly drunk, or there is blood all over the interior of the car, etc. Of course they can ask for you consent to search the car, and if you give it to them there’s no need for “reasonable suspicion.” (To search your house they need “probable cause” which requires even more evidence of foul play, or you can just consent.) In the case of searching for a fugitive, I am not sure they can require every car to pop the trunk without specific and individual reasonable suspicion of the individual at the checkpoint. I would be okay with that. Perhaps someone can fill us in.

    When I read this story this morning about people not being able to return to their homes for a very extended period of time, I thought to myself that I would be upset and I wonder about the principles of fairness, justice and constitutional rights here.

    We often hear about people kept from their homes when there’s a wildfire or other natural disaster. That’s ok in my book because there’s probably little the homeowner can do, and they will not only be in the emergency crews way, but may get in trouble and require evacuation, or otherwise burden emergency crews.

    But with a fugitive it feels a little different. The homeowner may have more of a fundamental right based on the Constitution and case law to be at home in this scenario, and protect her castle as she sees fit. It’s not an “act of God” (eg Fire, flood) but the risk of an intruder, something that homeowners face every day.

    If they keep me from returning to protect my home/family in this case, I would expect it to be of a very limited scope: one subdivision at a time, based on very specific information, then let the residents back after no more than a few hours. Not multiple neighborhoods and not overnight unless the circumstances are extremely dire, like siege, gunmen and hostages.

    The problem is not that cops are bad people. The problem is that cops are just people. Most people tend to over-reach convention when they think they are justified. “Well these are ‘exigent circumstances’ so we are going to impose the equivalent of martial law on multiple neighborhoods over a huge area for an undetermined period of time because we are the police and there is a grey area here and we simply believe the ends justify the means.” Well, no, not necessarily, that’s why we have courts and a constitution. Cops are just people, but people with a lot of power, so we need to keep them in check. Search and seizure law is supposed to be “minimally intrusive.” Sometimes this is an inconvenience to police. So be it.

  65. Honestly, how many of you have loved ones out there searching? They live by a code of honor. If you don’t respect that now, please don’t call them when you are in an accident, get your house broken into, or someone assults you! I have two young kids at home and I have to watch him leave to go on the search and you people do not have all the facts! I cried the first time I heard this and still look at it everyday. You apparently have not been to a funeral they have held, or to a military funeral. You ignorant people!
