PSP Commissioner Paris’ Stay Request Before The District Court Is Granted In Suarez, Et Al. v. Paris

Minutes ago, Judge Christopher Conner granted PSP Commissioner Paris’ request to stay the decision rendered in Suarez, et al. v. PSP Commissioner, 1:21-cv-710 (Middle District of PA), even though the Commissioner not only failed to comply with the Local Rules of the Middle District of Pennsylvania but more importantly, the Third Circuit has stated it is an “extraordinary remedy” and one for which he was unable to point to anything new, only repeating the same arguments as he did in his prior briefing, which the Court found to provide “nothing of evidentiary value in support of his position.”

As the binding precedent does not support a stay, it is likely that we will seek review by the Third Circuit in the near future. However, as of now, the Suarez decision is stayed and Section 6106 can be enforced, as written.

  1. I cannot believe that a stay was granted for this. No substantial evidence that this ruling is a danger to anyone. How do they proceed now? Can the stay be overturned, or does the appeal hearing have to be done before this progresses?
