Late yesterday, Chief Counsel Joshua Prince of the Firearms Industry Consulting Group (“FICG), a division of Civil Rights Defense Firm, P.C., filed a letter on behalf of Firearm Owners Against Crime – Institute for Legal, Legislative and Educational Action (FOAC-ILLEA) with York City Council regarding its recent consideration of an unlawful and unconstitutional firearm proposal.
As addressed in FOAC-ILLEA’s letter to City Council, in direct defiance of the legion of precedent from the Pennsylvania Supreme and Commonwealth Courts, the proposal seeks to ban the discharge of firearms in the city, with limited exceptions, and the discharge or carrying of firearms, in toto, in the City during a declared state of emergency by the Mayor or an extension of a proclamation of emergency by the City Council. As our viewers may remember, in Firearm Owners Against Crime, et al v. Lower Merion Township, the Commonwealth Court ruled that discharge provision are preempted under Pennsylvania’s firearm and ammunition preemption statutes and just last week, the Third Circuit Court of Appeals ruled in Lara v. PA State Police Commissioner, 21-1832, 2024 WL 189453 (3d Cir. Jan. 18, 2024), that Pennsylvania’s State of Emergency provision was unconstitutional as it relates to those between 18 and 21 years of age.
As the enactment of any such ordinance would be a criminal offense, York County District Attorney David Sunday was copied on the letter to City Council.

With our 2nd Amendment rights being attacked at both the Federal and State level, and the ATF (Burea of Alcohol, Tobacco, Firearms, and Explosives) trying to close down FFLs (Federal Firearms Licensees) for minor infractions while making FFLs the scapegoat when the ATF's records are inaccurate, I want to take this opportunity to introduce myself. You can often find me posting on several internet forums, including Subguns, Uzitalk, AR15, and PAFOA. I also hold PA Firearms Law classes for local ranges to inform the public on the firearm laws of the Commonwealth.
Following in my father's footsteps, I am also a Board member for the Pottstown Police Athletic League (PAL).
