Third Circuit Court Of Appeals To Review Stay in Suarez, et al. v. Paris Case

As our viewers are aware, on Monday, District Court Judge Christopher Conner granted PSP Commissioner Paris’ request to stay his decision striking down major portions of the Uniform Firearms Act in Suarez, et al. v. PSP Commissioner, 1:21-cv-710 (Middle District of PA). Today, Chief Counsel Joshua Prince of the Firearms Industry Consulting Group (“FICG), a division of Civil Rights Defense Firm, P.C., filed a motion with the Third Circuit Court of Appeals requesting that the stay be lifted and vacated, or in the alternative, the case be expedited.

As set-forth in the motion, beyond the Commissioner failing to comply with the local rules and meet the necessary criteria for a stay before the District Court, the issuance of the stay is extremely prejudicial to everyone in the Commonwealth; placing them in a position of felony prosecution merely for exercising their rights protected by the Second Amendment, as confirmed by the U.S. Supreme Court in New York State Rifle & Pistol Ass’n v. Bruen, 597 U.S. 1 (2022).

Pursuant to the local rules, PSP Commissioner Paris now has 7 days to respond and thereafter, we will have 3 days to file a reply brief.
